These general terms and conditions of use ("Terms of Use") govern access to and use of the PetsParadise Platform for the publication and consultation of animal listings, adoption and the directory of professionals. By using the Platform, the user ("the User") accepts these Terms of Use.
Article 1 — Purpose & role of intermediary
PetsParadise is a connecting platform. It acts as a technical intermediary and is not a party to the relationships (sale, gift, adoption, service) established between Users. The Platform guarantees neither the conclusion nor the proper performance of these relationships.
Article 2 — Access & account
Consultation is free. The publication of listings, the sending of messages and certain functions require the creation of an account. The User provides accurate information, maintains the confidentiality of their credentials and is responsible for all activity under their account. Registration is reserved for persons with legal capacity within the meaning of Swiss law.
Article 3 — Verification & badges
Professionals and breeders may submit documents (identity, cantonal authorizations, kennel name, certificates) in order to obtain trust badges. The Platform may verify, suspend or withdraw a badge. A badge does not constitute an absolute guarantee and does not engage the liability of the Platform.
Article 4 — Rules for publishing listings
- Listings must be honest, accurate, not misleading and concern an animal that is genuinely available.
- They must comply with Swiss law, in particular the Animal Welfare Ordinance (OPAn) and the cantonal requirements (minimum age for transfer, weaning, authorizations, identification/microchipping).
- The following are prohibited: animal cruelty, the sale of protected or prohibited species, illegal breeding, fraudulent, defamatory, unlawful content or content infringing the rights of third parties.
- The User warrants that they hold the rights to the photos and texts they publish.
Article 5 — Shelters & adoption
Partner shelters and associations may publish free of charge. The shelter retains full control of the adoption process (selection, conditions, adoption contract). Publication creates no obligation to transfer.
Article 6 — Moderation
The Platform may, at any time and without notice, refuse, moderate, modify the ranking of or remove any listing or non-compliant content, and suspend or delete an account in case of breach. A reporting mechanism is made available to Users.
Article 7 — Messaging & reviews
The messaging system is intended for good-faith connections. Reviews must reflect a real experience and remain respectful. Spam, harassment, fraudulent contact details and attempts to circumvent the service are prohibited.
Article 8 — Professional offers & subscriptions
Paid plans (promotion, statistics, pro functions) may be offered to professionals, according to the conditions and rates indicated on the Pricing page. Unless otherwise indicated, subscriptions are monthly and cancellable; the billing and cancellation conditions are specified at the time of subscription.
Article 9 — Intellectual property & content license
The User retains their rights to their content and grants the Platform a non-exclusive, worldwide and free license to host, display and promote this content for the purposes of the service, for the duration of the publication.
Article 10 — Liability
The Platform is not responsible for the content published by Users, for the relationships between them, nor for damages resulting from the use of the service, within the limits permitted by law. The User is solely responsible for their listings and indemnifies the Platform against any third-party claim related to their content.
Article 11 — Personal data
The processing of data is described in the privacy policy. Users undertake to use the data of other Users (contact details) only for legitimate connection purposes, to the exclusion of any unsolicited prospecting.
Article 12 — Conduct & sanctions
Any fraudulent use, scam, impersonation, or animal cruelty results in immediate exclusion and, where applicable, a report to the competent authorities.
Article 13 — Modification of the Terms of Use, applicable law & jurisdiction
The Platform may modify the Terms of Use; continued use constitutes acceptance. Swiss law applicable; jurisdiction at the registered office of The Big Hub Sàrl, subject to mandatory jurisdictions.
